Acceptance of these terms
By accessing olibeli.com or creating an account, you agree to these Terms and conditions (the "Terms") and our Privacy Policy. If you do not agree, do not use the Service.
If you use Olibeli on behalf of a business, you confirm that you have authority to bind that business to these Terms.
About Olibeli
Olibeli is a Portugal-first online marketplace that helps parents and planners discover maternity and family service providers, and helps providers present their businesses to families.
Olibeli provides the platform. Unless we expressly say otherwise in writing, we are not a party to contracts between parents/planners and providers, and we do not supply the underlying services listed by providers.
Accounts and eligibility
- You must be at least 18 years old (or the age of majority in your place of residence, if higher) to create an account.
- You must provide accurate information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
- Notify us promptly at info@olibeli.com if you suspect unauthorised access to your account.
- We may refuse, suspend, or terminate accounts that violate these Terms or pose a risk to the Service or other users.
Parent/planner and provider roles
During account setup you choose how you will use Olibeli: as a parent/planner or as a business/provider. Features available to you depend on that role and on what is available on Olibeli at the time.
Providers are responsible for the accuracy of their business information, listings, availability, pricing (when shown), and communications with families. Parents/planners are responsible for evaluating providers and for their own booking decisions.
Acceptable use
You agree not to misuse the Service. Prohibited conduct includes, without limitation:
- Breaking the law or infringing others' rights, including privacy and intellectual property rights.
- Posting false, misleading, defamatory, discriminatory, or harassing content.
- Uploading malicious software, attempting unauthorised access, collecting data automatically in a way that harms the Service, or interfering with security or availability.
- Impersonating another person or misrepresenting your affiliation with a business.
- Using Olibeli to exploit, endanger, or inappropriately expose children.
- Collecting other users' personal data without a lawful basis and their appropriate awareness.
Your content
You retain ownership of content you submit (such as profile text, business descriptions, and images). You grant Olibeli a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and communicate that content as needed to operate and improve the Service.
You represent that you have the rights needed to submit that content and that it does not violate these Terms or applicable law.
We may remove or restrict content that violates these Terms, our Trust & Safety guidelines, or the law, or that creates risk for users or the platform.
Bookings, payments, and current features
Olibeli is still growing. Some marketplace features (including bookings, messaging, reviews, or payments) may be limited, in testing, or not yet available.
Unless we clearly state that Olibeli processes a payment for a specific transaction, any commercial arrangement is between the parent/planner and the provider. We do not guarantee that a listing is available, accurate, or suitable for your needs.
When paid features or payment processing are introduced, additional terms may apply and will be presented before you use those features.
Olibeli intellectual property
The Service, including its design, software, branding, and documentation, is owned by Olibeli or its licensors. Except for the limited rights needed to use the Service as offered, these Terms do not grant you any licence to use Olibeli trademarks or other intellectual property.
Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that listings or user content are accurate or reliable.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protections that may apply to you.
Limitation of liability
To the fullest extent permitted by law, Olibeli and its directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business reputation, arising from your use of the Service or from interactions between users.
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to Olibeli for the Service in the twelve months before the claim, or (b) fifty euros (€50).
Suspension and termination
You may stop using the Service at any time. You may request account closure by contacting us at info@olibeli.com.
We may suspend or terminate access if you breach these Terms, if required by law, or if needed to protect the Service or other users. We may also discontinue or change parts of the Service as Olibeli evolves.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the last updated date on this page. Significant changes may be communicated through the Service or by email where appropriate.
Continued use of the Service after updated Terms become effective constitutes acceptance of the changes, except where applicable law requires a different process.
Governing law and disputes
These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules that would apply another jurisdiction's law.
If you are a consumer residing in the European Union, you may also benefit from mandatory protections of your country of residence. Courts of Portugal will have jurisdiction, without prejudice to any mandatory consumer venue rights that apply to you.
